FishOn! Terms of Service

Welcome to FishOn!. These Terms of Service ("Terms") govern your access to and use of the FishOn! mobile application, website, and related services (collectively, the "Service"). By creating an account, accessing the Service, or participating in tournaments, you agree to these Terms.

FishOn! is operated by FIXATED FISH LLC.

1. Who We Are

FishOn! is a fishing tournament platform operated by FIXATED FISH LLC. If you have questions about these Terms, contact us at [support@fixatedfish.com](mailto:support@fixatedfish.com).

2. Eligibility and Accounts

You must be at least 18 years old, or otherwise have the consent of a parent or legal guardian who is authorized to agree to these Terms on your behalf, to use the Service.

You agree to:

  • provide accurate account information;
  • keep your login credentials and verification methods secure;
  • use an email address and any other contact information that you control; and
  • promptly update your information if it changes.

You are responsible for all activity that occurs under your account.

3. Fishing Tournaments and User Content

The Service allows users to create tournaments, join tournaments, upload catch photos, share messages, and submit other content. You retain ownership of the content you submit, but you grant FishOn! a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content as needed to operate, improve, moderate, and promote the Service.

You represent and warrant that:

  • your content is accurate to the best of your knowledge;
  • you have the rights needed to upload and share it;
  • your catches, measurements, and tournament submissions are genuine;
  • your content does not violate any law or the rights of any third party.

Tournament organizers are responsible for administering their tournaments fairly, including reviewing catches and applying tournament rules. FishOn! may provide automated tools such as measurement overlays, species identification, or rules guidance, but those tools may be imperfect and are provided for convenience only.

4. Rules, Regulations, and Safety

You are solely responsible for understanding and complying with all fishing, boating, wildlife, and safety laws that apply to you, including local, state, and federal regulations, licensing requirements, size limits, bag limits, seasons, protected species restrictions, and access restrictions.

Information shown in the Service about species, legality, seasons, or size requirements may be incomplete, delayed, or inaccurate. FishOn! does not guarantee that any regulatory guidance is current or correct. You must independently verify all applicable rules before fishing, keeping, transporting, or submitting a catch.

You are solely responsible for your own safety and the safety of others while using the Service.

5. Acceptable Use

You agree not to:

  • cheat, manipulate tournament outcomes, or submit false catches;
  • impersonate another person or create duplicate or misleading accounts;
  • harass, threaten, or abuse other users;
  • upload unlawful, infringing, obscene, or harmful content;
  • attempt to interfere with the Service, its security, or other users;
  • scrape, reverse engineer, or misuse the Service except as permitted by law.

We may suspend, restrict, or terminate accounts that violate these Terms or that create risk for FishOn! or other users.

6. Friends, Messaging, and Notifications

The Service includes social features such as friend requests, direct messaging, tournament chat, and push or inbox notifications. These features are provided to support the fishing community, and you agree to use them respectfully and lawfully.

FishOn! does not guarantee real-time delivery of any message, alert, code, or notification.

7. Organizer and Platform Discretion

FishOn! and tournament organizers may remove catches, reject submissions, cancel tournaments, moderate content, or take other reasonable actions to preserve fairness, safety, legality, or platform integrity.

We may preserve tournament history, standings, and related records where necessary for operational, legal, anti-abuse, or audit reasons, including after an account is deleted or a tournament is canceled.

8. Third-Party Services

The Service may rely on third-party providers for infrastructure and features, including hosting, storage, email, mapping, notifications, analytics, identity verification, or messaging. Your use of those portions of the Service may also be subject to the terms and policies of those providers.

9. Intellectual Property

The Service, including its software, branding, design, text, graphics, and underlying technology, is owned by FishOn! or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY.

FishOn! does not warrant that the Service will be uninterrupted, error-free, secure, or that any tournament result, catch verification outcome, measurement, location reading, species classification, or regulation guidance will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, FishOn!, FIXATED FISH LLC, and their affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, tournament opportunities, or other intangible losses arising from or related to the Service.

To the maximum extent permitted by law, the total liability of FishOn! for any claim arising out of or relating to the Service or these Terms will not exceed the greater of $100 USD or the amount you paid to FishOn! in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless FishOn!, FIXATED FISH LLC, and their affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising out of or related to your content, your use of the Service, your tournaments, or your violation of these Terms or applicable law.

13. Termination and Account Deletion

You may stop using the Service at any time. You may also request deletion of your account through the app's account deletion flow or by contacting [privacy@fixatedfish.com](mailto:privacy@fixatedfish.com) if you need assistance.

FishOn! may suspend or terminate your access if you violate these Terms, create legal or operational risk, or misuse the Service.

Some information may be retained as described in our Privacy Policy, including where retention is necessary for legal compliance, fraud prevention, dispute resolution, audit trails, or legitimate platform operations.

14. Changes to the Service or Terms

We may modify, suspend, or discontinue all or part of the Service at any time. We may also update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Service after updated Terms become effective means you agree to the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, except to the extent superseded by applicable federal law.
